CODE OF ORDINANCES
ORDINANCE ESTABLISHING A SLOW NO-WAKE AREA ON EAGLE RIVER WITHIN THE TOWN OF LINCOLN, VILAS COUNTY, WI.
Title and Purpose
The title of this ordinance is the Town of Lincoln Slow No-Wake Area Ordinance. A sole Ordinance to Regulate Boating Upon the Water of Eagle River and prescribing Penalties for Violation Therof. The intent of this orndinance is to provide safe and healthful conditions for the enjoyment of aquatic recreation consistent with the public rights and interest and the capabilities of the water resources.
Authority & Enforcement
The town board has the specific authority under §66.0119, 66.0435, 101.645, and 101.935, Wis. Stats., and the town’s village powers under §60.22, Wis. Stats., to adopt and enforce this ordinance. This ordinance shall be enforced by the officers of the Vilas County Sheriff’s Department. State boating laws as found in ss.30.50 yp 30.71, Wis. Stats., are adopted by reference here.
Wisconsin State boating penalties as found in §30.80, Wis. Stats., and deposits established in the Unifiorm Deposit and Bail Schedule established by the Wisconsin Judicial Conferences, are hereby adopted by reference and all references to fines amended to forfeitures and all references to imprisonment are deleted.
Severability
The provisions of this ordinance shall be deemed severable and it is expressly declared that theTown of Lincoln, Vilas County, Town Board would have passed the other provisions of this ordinance irrespective of whether or not one or more provisions may be declared invalid. If any provision of this ordinance or the application to any person or circumstances is held invalid, the remainder of the ordinance and the application of such provisions to other persons or circumstances shall not be affected.
Definitions
“Slow-no-wake” means that speed at which a boat moves as slowly as possible while still maintaining steerage control.
Slow No Wake Area
No person shall operate a boat faster than slow-no-wake in the waters of Eagle River at any time, beginning with the buoy at 45.916528, -89.279903 to the buoy at 45.91669, -89.28254 and including the relocation of the buoy at 45.914774, -89.282178.
Posting Requirements
The Town of Lincoln, Vilas County, shall place and maintain a synopsis of this
ordinance at all public access points within the jurisdiction of the Town, pursuant to the requirements of NR 5.15, Wis. Adm. Code.
Effective Date
This will become effective upon its passage.
